La interpretación biocéntrica del enfoque integral ecosistémico contenida en la Constitución de la República del Ecuador

Resumen

En la presente investigación, se aborda la interpretación biocéntrica de enfoque integral ecosistémico contenida en la Constitución de la República del Ecuador 2008, como base para poder comprender y aplicar las técnicas de constitucionalización del medio ambiente, así como mejorar garantía normativa del equilibrio entre el interés público y el interés particular, para conciliar los derechos de la naturaleza y las actividades antrópicas. Los resultados se asocian a la constante preocupación por preservar desde el derecho al Medio Ambiente, específicamente para establecer la necesaria Justicia Ambiental. Como métodos científicos de investigación se emplearon el Hipotético-deductivo, Histórico-Lógico, Exegético-analítico, Derecho Comparado y el Doctrinal.

ABSTRACT

In this research, the biocentric interpretation of the integral ecosystem approach contained in the Constitution of the Republic of Ecuador 2008 is addressed, as a basis for understanding and applying the techniques of constitutionalization of the environment, as well as improving the normative guarantee of the balance between the interest public and private interest, to reconcile the rights of nature and anthropic activities. The results are associated with the constant concern to preserve from the right to the Environment, specifically to establish the necessary Environmental Justice. As scientific research methods, the Hypothetical-deductive, Historical-Logical, Exegetical-analytical, Comparative Law and the Doctrinal were used.
