Analysis of effective cooperation in the crime of illicit association in rural áreas
Abstract
Effective cooperation has established itself as a key tool in the Ecuadorian criminal system, especially in the fight against complex crimes, even in rural areas. Therefore, this study aimed to analyze the effectiveness of effective cooperation in said system, by visualizing its application in rural areas. As well as determining the impact on investigative processes and the punishment of complex crimes in proportion to the protection of cooperators and their families. For this, a mixed, qualitative and quantitative methodology was carried out, based on the bibliographic and legal review of Ecuadorian criminal law. The results indicated that effective cooperation has contributed significantly to the dismantling of criminal organizations and the clarification of criminal cases. However, deficiencies were also identified in the protection of collaborators, by limiting their willingness to collaborate. In conclusion, it was established that, although effective cooperation has been shown to be effective, it is imperative to strengthen protection measures for cooperators and establish clear criteria for the proportionality between the information provided and the benefits in sentences, thus guaranteeing a criminal system. fairer and more efficient.
