Apuntes sobre los derechos de la naturaleza en la Constitución de la República del Ecuador del 2008

Resumen

En el artículo se analiza la relación entre la versión indígena Sumak Kawsay, el reconocimiento de la naturaleza como sujeto de derechos y el derecho a un medio ambiente sano, así como la concientización del constituyente de que los derechos de la naturaleza han existido a través de la Historia, por último, tratamos los artículos sobre el equilibrio entre la naturaleza y la humanidad. El objeto de nuestro artículo es el análisis puntual de algunos elementos que caracterizan los derechos de la naturaleza en la Constitución de la República del Ecuador 2008. Empleamos métodos teóricos como el histórico lógico y el analítico sintético y del nivel empírico el análisis de documentos. Los resultados los asociamos como parte de la preocupación nacional por proteger legalmente al medio ambiente.

ABSTRACT

In the article is analyzes the relation to the constitutional state of rights and justice and the rights of good living. From here we analyze the relationship between the indigenous Sumak Kawsay version, the recognition of nature as a subject of rights and the right to a healthy environment, as well as the awareness of the constituent that the rights of nature have existed through history, finally, we cover articles on the balance between nature and humanity. The purpose of our article is the timely analysis of some elements that characterize the rights of nature in the Constitution of the Republic of Ecuador 2008. We use theoretical methods such as logical history and synthetic analytical and empirical level document analysis. We associate the results as part of national concern to legally protect the environment.
